Privacy Policy

Last updated:

This policy explains how Auxilery collects, uses, discloses, and retains personal information when you visit our websites, contact us, or use an Auxilery product or service that links to this policy.

The company website today. The Auxilery landing page and these legal pages provide information about our company. Their page code does not use advertising pixels, analytics trackers, cookies, or browser storage, and does not offer accounts, checkout, or uploads. Our hosting and delivery providers process technical request data to serve and protect the site. If you contact us, we receive the information you send.

The product provisions below apply only when the relevant service offers those features and collects the described information. They do not mean that every Auxilery service collects every category of data.

1. Who we are and scope

Auxilery LLC, a New York, United States limited liability company ("Auxilery," "we," "us," or "our"), is the business responsible for the processing described here. Our websites, applications, and related offerings are referred to as the "Services." Our contact details are in Section 12.

This is our general company policy. A product may provide additional notices identifying its operator, data categories, providers, permissions, retention periods, and choices. A more specific notice governs the processing it describes if it conflicts with this policy. A separate written customer agreement governs information we process solely on a business customer's instructions; in that case, contact that customer about its handling of your information.

This policy describes data practices. It is not a request for consent, and simply visiting a website or accepting our Terms of Service does not supply consent where a separate choice is required.

2. Information we collect

  • Communications: information you send us, such as your name, email address, business details, messages, attachments, support requests, and feedback.
  • Technical requests: hosting and security providers may process IP addresses, request URLs, referring pages, dates and times, browser and device information, response codes, and error or security events to deliver and protect the Services.
  • Accounts and transactions, when offered: account identifiers, sign-in details, preferences, purchases, subscription status, and billing or transaction records. A payment processor or app store handles payment details where that is the payment method; the service's notice explains what we receive.
  • Content and interactions, when offered: material you submit or create using a Service, including files, text, prompts, images, audio, outputs, edits, ratings, and feature interactions. Collection depends on the product and its settings; a feature that operates only on your device does not send us its content merely because it is covered by this policy.
  • Other sources, when connected or used: information you authorize an integration to provide, a business customer provides to enable your use, or a platform provides when you submit an inquiry through an Auxilery advertisement. The connection or collection notice identifies the relevant source and information.

We collect information directly from you, automatically through the Services or their infrastructure, and from the sources described above. Information you provide is generally optional, but we may be unable to fulfill a request or provide a feature without the information it needs.

Do not submit passwords for other services, financial account credentials, government identification numbers, health records, biometric identifiers, precise location, or other sensitive information unless a Service specifically requests and supports it with the appropriate notice and safeguards. A broad reference to "content" does not authorize undisclosed collection of sensitive data or access to device permissions.

3. How we use information

Depending on the Service and information involved, we use information to:

  • Deliver and maintain the Services, fulfill requests, manage accounts or transactions where offered, and provide support.
  • Communicate with you about inquiries, service changes, security, and administrative matters, and send marketing where permitted and subject to your choices.
  • Understand performance, troubleshoot problems, test features, improve usability, and develop products and technology, subject to Section 4.
  • Protect people and systems, detect misuse and fraud, enforce agreements, resolve disputes, and satisfy legal obligations.
  • Measure or support advertising only where the relevant collection and sharing have been disclosed and applicable choices have been implemented.

Where a legal basis is required, we rely on performance of a contract for processing necessary to provide a requested Service; our legitimate interests in operating, securing, evaluating, and improving our business where those interests are not overridden by your rights; legal obligations; or consent for activities that require it. Research and AI processing require their own appropriate basis and are not automatically necessary to perform your contract.

4. Research, data science, and AI development

Auxilery develops technology. Where permitted by applicable law, the notice provided for the relevant Service, your choices, and our agreements, we may analyze lawfully collected information and content to conduct research, create datasets and derived features, evaluate systems, and develop, train, fine-tune, test, and improve machine-learning models, including large language models. These activities may support existing Services, new products, and commercial technology.

Personal information and private content. Before a Service uses identifiable information or private user content for model training, we will disclose the relevant data and purpose for that Service, establish an appropriate legal basis, and obtain separate consent where required. This general policy does not by itself enroll private messages, uploads, or connected-account data into a training program. We respect applicable objections, consent withdrawals, and product controls. Data obtained through restricted platform APIs, customer instructions, or confidential arrangements remains subject to those restrictions.

Aggregated and deidentified information. We may create and use information that is aggregated or deidentified so that it no longer identifies a person under applicable law, including for research, benchmarking, model development, and commercialization. We maintain required measures against reidentification and require recipients to do the same where required. Replacing a name with an identifier or hashing an email address does not automatically make information anonymous.

Models and derived technology. Subject to those restrictions and your rights, we may retain and use resulting statistics, methods, model parameters, and other technology. These materials are not exempt from privacy obligations merely because they are derived from data. If they contain personal information, applicable access, deletion, and other rights still apply. See our content license for the contractual rights you grant without transferring ownership of your original content.

A Service that sends personal information to a third-party AI provider will identify the provider, information shared, purpose, and applicable choices in its product notice or feature disclosure before the transfer, and request permission where required. Providers' independent model-training uses require an appropriate disclosure and lawful basis; using a provider to perform a feature does not automatically authorize unrelated training.

5. When we share information

  • Service providers: providers of hosting, content delivery, security, communications, support, and, where used by a product, storage, payment processing, analytics, or AI functionality. They receive information needed for the relevant work under appropriate contractual protections and use restrictions. Our company website uses Netlify for hosting and content delivery.
  • At your direction: recipients you choose, connected services you authorize, or people who can see content you deliberately publish. Their separate handling may be governed by their own policies.
  • Business administration: professional advisers, and affiliates where applicable, for the purposes described here and subject to appropriate protections.
  • Legal and safety matters: where reasonably necessary to comply with law or valid legal process, establish or defend claims, enforce agreements, or protect rights, safety, and security.
  • Business transactions: in connection with a proposed or completed merger, acquisition, financing, reorganization, or sale of business assets, subject to confidentiality and applicable privacy requirements. A transfer does not erase existing privacy commitments.
  • Advertising partners, where enabled: only as described in the relevant Service's notices and subject to the controls in Section 6.

We require parties receiving user data on our behalf to provide protections consistent with this policy, applicable law, and applicable platform requirements. Independent platforms, app stores, and services also process information under their own notices. We may share lawfully deidentified or aggregated information for the purposes in Section 4.

6. Cookies, analytics, and advertising

The current company website's page code does not set cookies or local storage or include Google Analytics, Google Ads tags, Meta Pixel, TikTok Pixel, or comparable advertising trackers. Hosting providers may use necessary technologies for delivery, security, or access controls. This website does not disclose visitor information to ad networks for cross-context behavioral advertising or sell it.

If an Auxilery Service adds cookies, analytics, advertising SDKs, remarketing, audience matching, or conversion measurement, its notice will describe the actual technologies, data, purposes, and recipients. For example, a disclosed integration with Google, Meta, or TikTok could share device or cookie identifiers and activity events for ad measurement or personalization. Those integrations are not activated by the existence of this policy.

Before enabling processing that requires consent, we will offer the required choice. Where a disclosure is considered a "sale," "sharing," or targeted advertising under applicable law, we will provide the required opt-out method and honor legally recognized opt-out preference signals, including Global Privacy Control where applicable. We will not send sensitive or prohibited data to advertising platforms contrary to law or their rules. Platform tracking permission, including Apple's App Tracking Transparency permission where applicable, is separate from this policy.

You may adjust browser cookies, device permissions, and platform advertising settings. The current company website does not track you across other businesses' websites in response to ordinary browsing, and its behavior is the same whether or not your browser sends a Do Not Track signal. Do Not Track and legally recognized opt-out signals are different mechanisms.

7. Retention, deletion, and security

We retain personal information only for as long as reasonably needed for the purposes described here or as required by law. The relevant period depends on the type of information, the duration of the relationship, the sensitivity and risks involved, applicable legal deadlines, and whether the purpose can be met with less information.

  • Correspondence and support records are retained as needed to handle your request, maintain relevant business records, and resolve related issues.
  • Technical and security records are retained for operational troubleshooting, misuse prevention, and investigation, taking account of provider retention settings.
  • For products with accounts, content, or purchases, the product notice specifies applicable retention details; records needed for taxes, fraud prevention, legal holds, or claims may need to be retained after an account closes.

When information is no longer needed, we delete it or deidentify it as appropriate. Copies in backups may remain until scheduled replacement or deletion and are restricted from ordinary use. Any continued retention must have a lawful justification; a content license is not a reason to ignore a valid deletion request.

We use reasonable administrative, technical, and organizational safeguards appropriate to the information and processing involved. No internet service, transmission method, or storage system can guarantee absolute security.

8. Your choices and privacy rights

Depending on your location and applicable law, you may have rights to know about and access personal information, receive a portable copy, correct inaccuracies, request deletion, restrict or object to processing, withdraw consent, and opt out of sale, sharing, targeted advertising, or certain consequential profiling. You may also have the right to limit certain uses of sensitive information and complain to a data protection authority. Withdrawing consent does not invalidate prior lawful processing.

Send requests to the privacy contact below, identifying the Service and the right you want to exercise. We may request information reasonably necessary to verify your identity or an authorized agent's authority. Do not send a password or sensitive identity document with your initial request. We respond within the time required by applicable law, explain applicable exceptions, and do not unlawfully discriminate against you for exercising your rights.

If we deny a request, you may reply asking for an appeal where available under applicable law. You may also contact your relevant regulator, including an EU supervisory authority, the UK Information Commissioner's Office, or your state attorney general.

Request deletion of an Auxilery account or data

The company website does not create accounts. For an Auxilery product covered by this policy, you may request account and associated data deletion through the privacy contact below. Include the product name and the email address or other identifier used for the account, and state whether you are requesting account deletion or deletion of particular data. We will verify the request and explain any lawful retention exceptions. Where an app offers accounts, it must also provide the deletion mechanism required by its app store; uninstalling an app does not itself delete an account.

Marketing messages, if sent, include an unsubscribe method; you may also contact us to stop them. Necessary transactional or security messages may still be sent. For research or model-development questions and applicable objections, identify the relevant Service so we can apply its controls and your legal rights.

9. International processing

Our providers may process information in the United States and other countries where they operate. These countries may have different data protection rules from your country. Where law requires a transfer safeguard, we use an applicable lawful mechanism, such as an adequacy decision or standard contractual clauses with any necessary supplementary measures. Contact us for information about a relevant transfer and its safeguards. Using a Service does not itself constitute consent to a transfer that requires separate consent.

10. Children

The Services covered by this general policy are not directed to children under 13 or anyone below the minimum age stated for a particular Service. We do not knowingly collect children's personal information in circumstances requiring parental consent without obtaining that consent. If you believe a child has provided information improperly, contact us so we can investigate and take appropriate action, including deletion where required. A product intended for children requires its own appropriate disclosures and protections.

11. Changes to this policy

We may update this policy as the Services and our practices change. We will update the date above and provide any additional notice or consent opportunity required for a material change. New language does not retroactively authorize incompatible uses of previously collected information or override earlier commitments without the notice and legal basis required for that change.
